Terms of service

These terms are an agreement between you and Mensa Education, Inc., a Delaware corporation (“LearnPest,” “we,” “us”). They govern your use of learnpest.com, Scout, and the other products and services we offer (together, the “platform”). By clicking to accept these terms, creating an account, or purchasing a course or subscription, you agree to them and to our Privacy Policy. If you do not agree, do not use the platform.

If you are accepting these terms on behalf of a company, you represent that you have authority to bind that company, and “you” includes the company.

The service

LearnPest offers continuing education courses approved by state regulatory agencies, individually and in bundles; licensing exam preparation, including Scout, our AI-powered study tool; and tools for companies to manage their teams’ training. Courses follow the rules set by the approving agency — including minimum seat time, quizzes, and final exams — and those rules are enforced by the platform. When you complete a course, we issue a certificate and report the completion to the relevant state agency.

Eligibility and your account

  • You must be at least 18 years old to create an account.
  • You must provide accurate information, including your real name and your own license details, and keep it current.
  • Accounts are personal. The person completing a course must be the licensee earning the credit — completing coursework on someone else’s behalf is fraud against your state licensing agency, and courses may require you to attest to this before starting.
  • Keep your login to yourself; you are responsible for activity on your account.
  • You authorize us to verify your license details with the issuing state agency and to update your account when the agency’s records change.

Company accounts

A company that purchases a subscription or manages its team’s training on LearnPest (a “Company”) may designate administrators.

Subscription scope. Each Company subscription covers one branch or location, identified at purchase (the “Subscribing Branch”), and the technicians who work there. Access may be given only to the Subscribing Branch’s own employees and contractors. It may not be shared with other branches or locations, franchisees, parent or affiliated companies, or anyone else, and it may not be resold. Each additional branch needs its own subscription. The platform fee covers the branch’s team account, and each technician added to it is charged the per-technician fee shown at checkout; removing and re-adding a technician, or adding a technician who works at another branch, does not avoid that fee. We may review enrollment, and if an account is being used for people outside the Subscribing Branch we may charge for the additional branches or technicians, suspend the account, or both. A technician’s completion records and certificates belong to the technician and follow their license, not the branch.

Administrators can enroll team members, assign courses, view each member’s enrollment status, progress, completions, and certificates, and receive reminders about the team’s license deadlines and outstanding training. The Company is responsible for the actions of its administrators and for obtaining whatever permission it needs from its employees to share their information with LearnPest. Administrators may not log in as, or complete coursework for, another person. If a team member leaves the Company, the Company should remove them from its account; the member’s completion records and certificates stay with the individual, and we continue to report them to the state agency as required.

Purchases, subscriptions, and refunds

  • Prices are shown at checkout and exclude any applicable taxes. Payments are processed by Stripe.
  • À-la-carte course purchases are one-time.
  • Automatic renewal. Company subscriptions, and any individual plan described as recurring, renew automatically at the end of each billing period for the same period at the then-current price, and are charged to the payment method on file until you cancel. We state the renewal term and price before you subscribe, and we send a reminder before an annual plan renews. You can cancel at any time from your account settings or by emailing support@learnpest.com; cancellation takes effect at the end of the current billing period, and you keep access until then. If we change a subscription price, we will give you at least 30 days’ notice before the new price applies.
  • If something went wrong with a purchase, contact support@learnpest.com and we will make it right. Refunds are generally available for courses you have not started; completed courses that have been reported to a state agency cannot be refunded.
  • If a payment fails, we may suspend access until it is resolved.

Continuing education credits

We report completions to state agencies and maintain the records they require, but your license compliance remains your responsibility: confirming that a course is approved for your specific license type and category, completing renewals on time, and meeting any requirements outside LearnPest. Credit acceptance is ultimately determined by the agency, not by us. Course approvals can change; if an approval for a course you have purchased is withdrawn before you complete it, we will tell you and refund the unused course. We do not guarantee that an agency will accept a course or renew your license.

Scout and AI features

Scout and other AI features generate explanations, practice questions, and study guidance automatically. They are study aids, not the course of record: AI-generated content can be incomplete or wrong, it does not replace the approved course materials or your state’s official exam references, and it is not legal, regulatory, or safety advice about pesticide use. Practice questions are not actual state exam questions, and we do not guarantee that using Scout will result in passing any exam or obtaining any license. Do not enter sensitive personal information into AI chat features. We may review AI interactions to improve the product, as described in our Privacy Policy.

Course content and intellectual property

Course materials — text, video, audio, quizzes, and exams — belong to LearnPest or its licensors. Your purchase grants you a personal, non-transferable license to use them for your own continuing education. Copying, redistributing, or sharing course content or exam questions is not permitted. The LearnPest and Scout names and logos are our trademarks. If you send us suggestions or feedback, we may use them without obligation to you.

Acceptable use

Don’t attempt to defeat seat-time tracking, share exam answers, misrepresent your identity, interfere with the platform’s operation, scrape or copy the platform, or use it for anything unlawful. We may suspend or close accounts that violate these terms, and we are obligated to be honest with state agencies — records of fraudulent activity may be shared with them.

Communications

By creating an account you agree that we may send you notices, receipts, certificates, and other communications about your account electronically, by email or in the platform, and that electronic notices satisfy any requirement that a notice be in writing. We will send you reminders about your license expiration and renewal deadlines and other service messages as part of your account. We may also send marketing email about courses approved for your state, new products and features, and offers; you can decline when you create your account and unsubscribe at any time, as described in our Privacy Policy. Text messages are sent only with your separate consent and can be stopped by replying STOP. Keep your email address current so that these messages reach you.

Privacy

Our Privacy Policy explains what information we collect, how we use it, and who we share it with, including state regulatory agencies and, for Company-managed accounts, your employer. By using the platform you agree to it.

Termination

You can close your account at any time by emailing support@learnpest.com. We may suspend or close your account if you violate these terms, if required by law or a state agency, or if we discontinue the platform, in which case we will give you reasonable notice and refund any unused prepaid course. On termination, your license to use course content ends. We retain completion records and certificates as required by state law and continue to make your certificates available on request. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, do survive.

Disclaimers

THE PLATFORM, COURSES, AND AI FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We work hard to keep the platform available and accurate, but we do not guarantee uninterrupted or error-free service, that any course will be accepted by a state agency, or that you will pass any exam or obtain or renew any license.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEARNPEST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSS OF A LICENSE OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND $100. Nothing in these terms limits liability that cannot be limited by law.

Indemnification

You agree to defend and indemnify LearnPest and its officers, employees, and contractors against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these terms, your violation of a state licensing law or regulation, or inaccurate information you provide to us or that we report to a state agency on your behalf.

Governing law and disputes

These terms are governed by the laws of the State of Utah, where LearnPest is based, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at support@learnpest.com and give us 30 days to try to resolve it informally. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction, except that either party may bring an individual claim in small claims court.

General

  • These terms and the Privacy Policy are the entire agreement between you and LearnPest about the platform and replace any earlier agreement.
  • If any part of these terms is found unenforceable, the rest remains in effect.
  • We may assign these terms to an affiliate or to a successor in a merger, acquisition, or sale of assets. You may not assign them without our consent.
  • Our failure to enforce a provision is not a waiver of it.
  • We are not responsible for delays or failures caused by events outside our reasonable control, including outages of third-party services.
  • Notices to you may be sent to the email address on your account. Notices to us should go to support@learnpest.com.

Changes

We may update these terms. For material changes we will notify you by email or in the platform at least 14 days before they take effect, and we may ask you to accept the updated terms the next time you sign in. Continued use after the effective date means you accept the updated terms. If you do not agree, stop using the platform and contact us about any unused purchase.
